Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and NRI Mart (“NRI Mart”, “we”, “us”, or “our”). By creating an account, placing an order, or using our website or mobile application (the “Service”), you agree to these Terms. If you do not agree, please do not use the Service.

You must be at least 18 years old (or the age of majority in your country) and able to enter a binding contract to use the Service. By using the Service, you confirm that you meet these requirements and that the information you provide is accurate and complete.

• You are responsible for keeping your account credentials secure and for all activity under your account.
• Notify us immediately at support@nrimart.com if you suspect unauthorized access.
• You may not share your account, sell access to it, or use another person's account without permission.

NRI Mart provides:

• Store orders: products from our curated catalog.
• Custom requests: sourcing of products from Indian sellers, marketplaces (such as Flipkart, Amazon India, Meesho), and physical stores on your behalf.
• Luggage shipping: door‑to‑door pickup and international shipping of personal luggage.
• Case manager service: a dedicated point of contact to coordinate your orders.

We may add, change, suspend, or remove features at any time. Pricing, weight limits, prohibited items, and shipping timelines depend on the destination country, courier partner, and applicable customs rules.

• Quotes for shipping or sourcing are estimates based on the information you provide. Final pricing is confirmed before shipment and may change if weight, dimensions, customs duties, or sourcing costs differ.
• You authorize us to charge your selected payment method for the order amount, applicable taxes, shipping fees, customs duties, and service charges.
• If a sourced product is unavailable, mispriced, or differs materially from your request, we will contact you for instructions and may issue a refund or alternative.
• You are responsible for any duties, taxes, or charges levied by destination‑country customs unless we have explicitly included them in your quote (DDP).

You agree not to ship items that are illegal, restricted, or prohibited by Indian export law, your destination country's import law, or our courier partners. These typically include:

• Currency, securities, and negotiable instruments.
• Firearms, weapons, ammunition, and explosives.
• Narcotics, controlled substances, and most prescription medicines without proper documentation.
• Live animals, perishables that violate import rules, and biological materials.
• Hazardous materials, flammable liquids, batteries beyond carrier limits, and aerosols.
• Counterfeit goods, items that infringe intellectual property, and stolen property.
• Any other items prohibited by applicable law.

We may refuse, return, or dispose of any shipment that we reasonably believe contains prohibited items, and you remain liable for related costs and any legal consequences.

You are responsible for providing accurate descriptions, values, and documentation for the items you ship. False or misleading customs declarations are illegal and may result in seizure, fines, or criminal liability. NRI Mart will not knowingly file an inaccurate declaration on your behalf.

• Delivery times are estimates and depend on courier partners, customs clearance, weather, and force‑majeure events.
• Risk of loss generally passes to you on delivery to the address you specify.
• If a shipment is delayed, lost, or damaged, please notify us within 7 days of the expected delivery date so we can investigate with the courier.

• You may cancel an order before sourcing or shipping has begun for a full refund of the cancellable portion.
• Once a product has been sourced, refunds depend on the seller's return policy. Service fees and non‑refundable shipping costs may not be refundable.
• Damaged or incorrect items: contact us within 7 days of delivery with photos. We will work with you and our partners on a resolution, which may include refund, replacement, or store credit.

You retain ownership of content you upload (photos, product links, messages). By uploading, you grant NRI Mart a worldwide, royalty‑free licence to use that content solely to operate and improve the Service (for example, to source the product you requested or train our internal quality processes).

You agree not to:

• Use the Service to violate any law or third‑party right.
• Upload malicious code or attempt to disrupt the Service.
• Reverse engineer, scrape, or copy the Service except as permitted by law.
• Use the Service to harass, defraud, or impersonate others.

The NRI Mart name, logo, website, mobile application, and all related content (excluding your user content and third‑party content) are owned by NRI Mart or its licensors and are protected by intellectual‑property laws. We grant you a limited, non‑exclusive, non‑transferable licence to use the Service for personal, non‑commercial purposes in accordance with these Terms.

When you ask us to source from a third‑party seller or marketplace, the underlying product is supplied by that seller and may be subject to their terms, warranties, and return policies. We act as your sourcing and shipping partner and are not liable for the manufacture or quality of third‑party products beyond what is required by applicable consumer‑protection law.

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee uninterrupted or error‑free operation of the Service.

To the fullest extent permitted by law, NRI Mart and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or in connection with your use of the Service.

For shipping‑related claims, our liability is limited to the declared value of the shipment or the amount paid for the affected order, whichever is lower, except where our courier partner's tariff provides otherwise. Nothing in these Terms limits liability that cannot be limited under applicable law (such as liability for fraud or for death or personal injury caused by negligence).

You agree to indemnify and hold harmless NRI Mart and its partners from any claims, damages, losses, and reasonable legal fees arising out of (a) your breach of these Terms, (b) inaccurate customs declarations, (c) shipping prohibited items, or (d) your violation of any law or third‑party right.

We may suspend or terminate your account if you breach these Terms, attempt to defraud us or others, or use the Service for unlawful purposes. You may close your account at any time by contacting support@nrimart.com. Sections that by their nature should survive termination (such as payment obligations, disclaimers, limitation of liability, and dispute resolution) will continue to apply.

These Terms are governed by the laws of India. Subject to applicable consumer‑protection law in your country of residence, any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana, India.

We may update these Terms from time to time. When we make material changes, we will notify you through the app, email, or a notice on our website, and update the “Effective date” above. Your continued use of the Service after the change means you accept the updated Terms.
